Hore set for hefty ban

New Zealand hooker Andrew Hore has been cited for an off-the-ball incident which subsequently hospitalised Wales lock Bradley Davies.

Hore hit Davies off the ball during the initial stages of last Saturday’s Test in Cardiff. The incident was missed by matchday officials, but Hore has now been cited and looks likely to receive a lengthy suspension.

The time and date of the hearing, before the IRB’s appointed independent judicial officer, have yet to be fixed.

All Blacks coach Steve Hansen expects the hooker to be sidelined for some time. Hansen did not say as much, but has already called for a replacement ahead of the coming Test against England.

Dane Coles is expected to start at Twickenham.

    Anyway, this won’t be a small ban. After the whole IRB appeal of the Thomson ban, they’ll be very aware of not gently stroking All Black cawck at the disciplinary hearing again.

    Hore lost the plot and the old brutal violence associated with Men in Black came out in him
    So what kind of penalty should he receive ?
    First lets look at some similar cases from the November tours where the standards have already been set

    Andy Powell
    Head high forearm concussing McCaw =no citing
    Dylan Hartley
    forearm smash to face of McCaw = no citing
    Martin Johnson
    knocks out Marshall with blind punch = no citing
    Stephen Jones
    kicks Brendon Leonard in the face concussing him = no citing

    Last cricket post but have to say what a boon the DRS is to the game. We could have lost the game had it not been for DRS. I wonder how many games’ outcomes pre-DRS would have been affected, had they this technology at their disposal?

    Exactly. that’s what I want to know too. What about the mitigating circumstances?

    I mean, not even three minutes before this incident, Hore and his mates were openly edging each other on to commit gruesome atrocities on anyone wearing red in what is affectionately known as the “haka”. Say what you want, but that gets the blood up. Surely this has to be taken into account?

    India is the main antagonist for it but ironically they appeal for lbw on nearly every other delivery

    Let it load once properly, then it will play at normal speed. Note the terrible knee to an already unconscious head at the end. This will be a landmark case for the disciplinary process and the IRB.

    As a matter of fact, I believe Bradley Davies should lay a charge of battery against Andrew Hore.

    Battery is the unlawful touching of another person.

    In sport, one consents to physical contact, as long as the conduct is lawful sporting activity according to the rules.

    Once a player acts outside the rules of the sport, the defence of consent no longer exists.

    It would be very easy to prove a case of battery against Andrew Hore.

    “I mean, no-one has said a thing about the vicious headbutt on Andrew’s fist, or the state his knee is in after a second headbutt, which nobody saw. He has a bruise and everything, and Ma’a had to give him his last Hello Kitty plaster, which put a damper on the boy’s spirits. He’s a top bloke you know, and no-one deserves a bruised knee and a sore fist in one game. It’s very frustrating but we’ll back him to the hilt. I hope the Welsh boys do the right thing and buy him some new plasters.”

    There is no license for thuggery.

    The inherent violence of a contact sport cannot go unhindered in terms of English case law: as Chief Justice Lord Lane observed in R v Lloyd, that while “forceful contact was allowed by the rules…[t]he game was not, however, a licence for thuggery.”

    R v Billinghurst (1978) was the first successful prosecution of a rugby player for assault occasioning actual bodily harm for incidents occuring on the field of play. The case centred on an amateur rugby game in South Wales where, during the course of a rather rugged encounter, the accused broke his opponent’s leg. The victim was a prison officer whose principals were not content to lose his services in such a manner without an attempt to let similar offenders realise the potential consequences of such behaviour. Therefore, by the time David Bishop, a Welsh international player, punched an opponent on the ground, away from the ball, during a club rugby match in 1986, an incident which attracted considerable amounts of publicity, neither he nor his club could claim that they were unaware of the legal consequences. In the case itself, David Bishop pleaded guilty to common assault for the “off-the-ball” incident and was duly convicted and sentenced to one month imprisonment, varied to one of twelve months suspended by the Court of Appeal.

    See it again, in all its gory glory. And note how he aims his left knee at the head of the already unconscious Davis and drops it with force into the temple area. Everyone’s going on about the swinging sucker punch, but that knee could have killed the man. Watch what happens to his head and neck when the second blow lands.
