Hore set for hefty ban

New Zealand hooker Andrew Hore has been cited for an off-the-ball incident which subsequently hospitalised Wales lock Bradley Davies.

Hore hit Davies off the ball during the initial stages of last Saturday’s Test in Cardiff. The incident was missed by matchday officials, but Hore has now been cited and looks likely to receive a lengthy suspension.

The time and date of the hearing, before the IRB’s appointed independent judicial officer, have yet to be fixed.

All Blacks coach Steve Hansen expects the hooker to be sidelined for some time. Hansen did not say as much, but has already called for a replacement ahead of the coming Test against England.

Dane Coles is expected to start at Twickenham.

    Although in the case of Bakkies, there may be a case for repeat offenses being worth pursuing.

    On a lighter note: I can’t recall when exactly it was but Piet Bester received a yellow card within the first 2 minutes of a match, playing for Griquas: his reply to one of his team mates” question of why he struck the opponent, he said: “Hy soek al die hele wedstryd k#k met my” (“he’s been looking for sh*t the whole match”) !!

    Criminal law requires beyond a reasonable doubt. i.e. Hore would have to be proven to have acted with the deliberate intention of injuring Davies.

    That would never happen.

    The IRB judiciary has no such constraints. The mere face it was not a good look for the game is enough to make him guilty.

    Drop the idiot side show argument. It has no merit.

    @244 except burger geldenhyus had just been punched by Andy Haden in a ruck and got up and hit the first bloke he saw which was dalton. Still it was from behind so not great, but no one had antagonized Hore except the Haka. Time for that stupid dance to be banned as well.     Listen, bud.

    Under English law, the mens rea for battery is intention OR recklessness. You can go read up R v Venna if you like (from 1976).

    As long as they can prove that Hore was aware of the risk that the result will occur if he acted as he did and did so act where no reasonable person would – no intent is required, and the elements of the crime of battery are met.

    Let’s put out the elements, shall we. Under section 39 of the Criminal Justice Act 1988 battery is a summary offence, punishable by up to 6 months’ imprisonment, a fine not exceeding £5,000, or both. It is a common-law offence.

    The actus reus of battery consists of the (1) unlawful (2) application of force (3) on another.

    There is no need to prove harm – a mere touch can be sufficient. More importantly, the victim need not be aware that he or she is about to be struck. If someone is struck from behind this will still constitute battery.

    The mens rea of battery is intention or Cunningham recklessness.

    Recklessness as defined in R v Cunningham is a subjective test: Did the defendant foresee the harm that in fact occurred, might occur from his actions, but nevertheless continued regardless of the risk?

    Wasn’t kempo arrested after a game in the UK a few weeks ago on battery charges?

    The hit was on a player from the USA but the match was in the UK.

    He just shouldered the guy,

    Came to nothing, but still, it does show precedent.

    Mind you I don’t agree with that sort of thing as a rule.

    I’d consider making an exception for an All Black player though. :D
